Article 1 (Purpose)

The purpose of this Emotion Castle Cinema Terms and Conditions (hereinafter referred to as the "Company") is to prescribe rights, obligations and responsibilities between the Company and its members and other necessary matters in connection with the use of Emotion Castle Cinema provided by SAMG Entertainment (hereinafter referred to as the "Company").

Article 2 (Definitions)

  • 1. "Emotion Castle Cinema" means a video streaming service provided by the company
  • 2. The term "member" means a person who has agreed to these terms and conditions as a member of the "Emotion Castle Cinema" service. However, the family members of the member can also hold and use the profile through the member's account.
  • 3. The term "video content" means data or information expressed in images used in an information and communication network under Article 2 (1) 1 of the Information and Communication Network Utilization Promotion, Information Protection, etc. Act.
  • 4. The term "third-party video content" means video content in which a third party holds all copyrights and other intellectual property rights.
  • 5. The term "company video content" means video content in which the company holds all copyrights and other intellectual property rights alone or in collaboration with a third party.
  • 6. The term "post" means articles, photos, videos, various files and links (regardless of form or format) in the form of information such as text, voice, sound, images, videos, etc. registered in this service.
  • 7. 'Monthly payment' refers to the status of registering monthly payment after signing up for Emotion Castle Cinema.

Article 3 (Explanation and explanation of the terms and conditions and amendments)

  • ①The company will post these terms and conditions, trade name and representative name, business address, telephone number, e-mail address, business registration number, and mail order number on the initial service screen of the app for easy access to members. However, the details of the terms and conditions can be viewed by members through the connection screen.
  • ② The company may amend these terms to the extent that it does not violate related laws such as the Consumer Protection Act in e-commerce, the Regulation of Terms and Conditions, the Framework Act on Electronic Documents and Electronic Transactions, the Electronic Signature Act, the Act on Promotion of Information and Information Protection, etc.
  • ③ If the company revises the terms and conditions, it shall specify the date of application and the reason for the revision and notify the current terms and conditions on the notice screen of this service from 7 days before the application date (30 days if changes are disadvantageous to members).
  • ④ The terms and conditions changed under paragraph (3) shall not be applied retroactively before the application date unless there are special provisions or other unavoidable reasons in the relevant statutes.
  • ⑤ If a member does not explicitly express his/her refusal after the date of application announced under paragraph (3), he/she shall be deemed to agree to the revised terms and conditions, and a member who does not agree to the changed terms and conditions may request his/her withdrawal. Notwithstanding the measures of paragraph 3, the Company shall not be liable for damages to members caused by not knowing the amendment of the terms and conditions.
  • ⑥ Matters not prescribed in these terms and interpretations of these terms and conditions shall be governed by relevant laws and regulations such as the Consumer Protection Act in E-Commerce, etc., the Regulation of Terms and Conditions, and the Consumer Protection Guidelines in E-Commerce, etc. set by the Fair Trade Commission.
  • ⑦ If the provisions of these terms and conditions conflict with the compulsory laws of the Republic of Korea, they shall be governed by the compulsory laws. In this case, the effectiveness of the other provisions shall not be affected.

Article 4 (Application for Subscription to this Service)

  • ① This service can be subscribed by the user's consent to these terms and conditions.
  • ② The company approves the application for membership if the person who has applied for membership pursuant to paragraph (1) does not have any restrictions under these subparagraphs. As soon as the company approves the application for membership, the applicant becomes a member, and a contract between the company and the member (hereinafter referred to as "this service use contract") is deemed to have been established.
    • 1. Where an applicant has previously lost his/her membership due to a violation of these terms and conditions
    • 2. Where it has been less than one month since the withdrawal at the request of the member
    • 3. Where there is a clear false entry, omission, or error in the member information entered by the applicant for subscription
    • 4. When the company performs the identification process, it is not identified or it is confirmed that it is not the person
    • 5. If the applicant is under the age of 14

Article 5 (Rating of Video and Hazardous Media for Youth)

  • ① The company may restrict the use of services by members or request procedures such as age and identity verification to comply with relevant laws and regulations, such as the Act on the Promotion of Movies and Videos and ② If the video content provided by the company is classified according to the Act on the Promotion of Movies and Videos, the member shall watch videos or prevent others from watching them in violation of the classification.

Article 6 (Change of this service, quality of use))

  • ① The Company will continue to strive to provide this Service continuously and reliably. However, the company may take other necessary measures, such as maintenance, replacement, failure, communication failure, changes in the company's policy regarding the provision of this service, suspension of all or part of this service, or change the resolution and file size of streaming video content.
  • ② If the Company intends to discontinue or change the contents, usage, and hours of use of the Service, the Company shall notify the details, reasons, and dates of the Service to be discontinued or changed in advance on the notice screen of the Service.
  • ③ Despite the company's efforts, the screen quality of video content can be affected by a variety of factors, including devices, regions, available Internet bandwidth, and Internet connection speed, and the company does not guarantee the resolution or quality of video content received by members through streaming.

Article 7 (Attribution of Copyrights, etc.)

  • ① All copyrights and other intellectual property rights in all trademarks, marks, logos, designs, texts, scripts, graphics, transmission functions, etc. related to the Service are exclusively owned by the Company. All copyrights and other intellectual property rights in the contents of the Company's videos are also exclusively owned by the Company, but there may be cases where third parties jointly own intellectual property rights.
  • ② Members shall not reproduce, download, perform, publicly transmit, display, publish, distribute, lend, create derivative works from, or otherwise use or alter any information contained in or obtained through the Service (including, but not limited to, the video content described in paragraphs 1 and 2 above, and all trademarks, marks, logos, designs, text, scripts, graphics, transmission functions, etc. related to the Service) to which intellectual property rights belong to the Company or a third party without the prior written consent of the Company. Members shall not use or modify the information contained in the Service or the video content for commercial or non-commercial purposes, or use, transfer, sell, or pledge it to a third party. In particular, members shall use the video content of the Service as an end consumer, and shall not play it in business premises, stores, etc. or perform it in public for commercial purposes.

Article 8 (Obligations for Member's ID and Password)

  • ① Members shall not make their ID and password available to any third party.
  • ② Notwithstanding paragraph (1), a Member may create multiple profiles within a particular ID and allow members of the Member's family to use those profiles. In this case, the Member shall be responsible for ensuring that the family member does not watch videos or access youth-orientedmedia in violation of the classification in accordance with Article 4.2, and shall be responsible for the management of the ID and password. For clarity, family members are prohibited from accessing any other websites, apps or services provided by the Company.
  • ③ If a Member becomes aware that his/her ID and password have been stolen or are being used by a third party (except for the use of the profile by family members permitted under paragraph 2), he/she shall immediately notify the Company and comply with the Company's measures, if any.
  • ④ The Member shall be responsible for all disadvantages caused by the Member's failure to give notice under Paragraph 4 or to respond to the Company's actions.

Article 9 (obligations of members)

  • ① Members shall comply with the relevant laws and regulations, the provisions of these Terms and Conditions, the Company's policies ("Service Use Policy", "Emotion Castle Cinema Review Operation Policy", etc.), and the matters notified or announced by the Company, such as usage guidelines, and shall not engage in any other acts that interfere with the Company's business.
  • ② Members shall not engage in any of the following acts in connection with the use of this service.
    • 1.registration of false information when applying for or changing the subscription of this service
    • 2.transmitting or posting information (computer programs, etc.) other than the information specified by the Company
    • 3.infringement of intellectual property rights, including copyrights, of the Company or third parties
    • 4.damage the reputation or interfere with the work of the Company or any third party
    • 5.disclose or post obscene or violent messages, images, voices, or other information that violates public order and morals on the Service.
    • 6.customer support content is abusive, violent, sexual harassment, etc.
    • 7.using the service for fraudulent purposes by writing false reviews, etc.
    • 8.disclose or post information on the Service that violates the "Emotion Castle Cinema Review Operating Policy", such as information that is illegal, infringes on the rights of others, violates public order and morals, or reviews that do not meet the purpose of operation.
    • 9.transferring or lending one's ID and password to a third party, etc. (except in the cases described in Article 10, Paragraph 2 of these Terms)
    • 10.make statements that interfere with the company's business without good cause
    • 11.interfering with the Company's normal services by using this service in a manner different from the normal use of this service
    • 12.any other behavior deemed to violate applicable laws, these Terms, or the Company's policies.
  • ③ The Company may terminate this Service Use Agreement in accordance with Article12 of these Terms and Conditions if the Member engages in any of the prohibited acts set forth in Paragraph 2.

Article 10 (member's posts)

  • ① The copyright and all responsibilities for the posts made by the members belong to the members who posted them. However, if the Company determines that the contents of a post posted or registered by a member fall under any of the following items, the Company may delete or take temporary measures against the post.
    • 1.the content violates public order and morals
    • 2.is believed to be related to a criminal offense or conspiracy to commit a criminal offense.
    • 3.infringes on any copyright or other rights of the Company or any third party.
    • 4.the content is not relevant to the product.
    • 5.is in violation of or related to applicable laws, the Company's terms and conditions, and the "Emotion Castle Cinema Operating Policy".
  • ② If a member commits an act that violates the Company's "Emotion Castle Cinema Operating Policy," the Company may take measures such as restricting the right to create posts and purchase activities, and the specific details of the restrictions are in accordance with the "Emotion Castle Cinema Operating Policy."
  • ③ The Company has full rights to the data created by the Company by aggregating and analyzing Member's posts.
  • ④ Unless otherwise deleted by the member, the member grants the Company the right to expose, use, store, modify, reproduce, transmit, perform, display, distribute, publicly transmit, and otherwise use the member's posts on a worldwide and perpetual basis for purposes such as exposure in the Service, utilization to promote the Service, operation and improvement of the Service, and statistical survey and research for new development. This includes, but is not limited to, the following forms of use.
    • - Modify a Post, such as by converting or simplifying its size, for use within the Services (including when the Services are offered within a portion of a site or media operated by a third party).
    • -Reproducing, transmitting, or displaying posts on other sites operated by your company or sites operated by other companies.
    • -To cause the media, telecommunications companies, etc. to report or broadcast the contents of the post for the purpose of promoting the Company's services. However, in this case, the Company may provide the post to the media, telecommunications companies, etc. according to the scope of the member's disclosure settings, and will not provide member information without the member's individual consent.

Article 11 (Takedown Requests)

  • ① If a member's post contains content that violates relevant laws such as the 「 Act on Promotion of Information and Communications Network Utilization and Information Protection 」 , 「 Personal Information Protection Act」, and 「Copyright Act」, the right holder may request the suspension or deletion of the post in accordance with the procedures prescribed by relevant laws (hereinafter referred to as "right infringement report"), and the Company shall take measures such as temporary measures (blind processing) in accordance with relevant laws if a right infringement report is received.
  • ② Even if there is no request from the right holder pursuant to the preceding paragraph, the Company may take temporary measures against the postings in accordance with the relevant laws and the "Emotion Castle Cinema Service Use Policy" if there are reasons to recognize infringement of rights or other violations of the Company's policies and relevant laws.
  • ③ The detailed procedures under this Article shall be in accordance with the "Emotion Castle Cinema Operation Policy" established by the Company within the scope of relevant laws and regulations such as the 「Act on Promotion of Information and Communications Network Utilization and Information Protection」, 「Personal Information Protection Act」, and 「Copyright Act」.

Article 12 (Restrictions on Use, etc.)

  • ① The Company may immediately take measures such as caution, warning, temporary suspension, permanent suspension of use, or termination of the service use contract if the user violates the obligations of these Terms and Conditions or interferes with the normal operation of the service, and the user shall be legally responsible.
  • ② The Company may immediately take measures such as caution, warning, temporary suspension, permanent suspension, or termination of the service use contract if the member violates the relevant laws and regulations due to impersonation payment theft in violation of the Resident Registration Act, telephone number theft, provision and operation interference of illegal programs in violation of the Copyright Act, illegal communication and hacking in violation of the Act on Promotion of Information and Communications Network Utilization and Information Protection, distribution of malicious programs, excessive use of access rights, credit card fraudulent transactions in violation of the Credit Specialized Financial Business Act, or other similar forms of fraud, and the member shall be legally responsible for the same.
  • ③ If a member does not log in to the Service for more than one year, the Company may restrict the use of the Service in order to comply with the 「Act on Promotion of Information and Communications Network Utilization and Information Protection, etc.」, protect member information, and improve operational efficiency.
  • ④ If the Company restricts the use of the Service or terminates the Service Use Agreement in accordance with this Article, the Company will notify the Member via the email address specified in the Member's personal information.

Article 13 (company's obligations)

  • ① The Company shall not engage in any acts prohibited by applicable laws and these Terms, and shall make commercially reasonable efforts to provide the Service continuously and stably.
  • ② The Company shall establish, disclose, and comply with the Privacy Policy to protect the personal information of members so that members can safely use the Service.
  • ③The Company prohibits for-profit advertisements in the Company's video content and all posts that can be registered by the Company and its members.
  • ④ The company does not register company video content that sells goods and services.
  • ⑤ The Company guarantees that the contents of the Company's videos uploaded or broadcast within the Service are not contents that infringe on intellectual property rights, and conducts intellectual property infringement monitoring for posts registered within the Service to periodically check for copyright infringement.

Article 14 (Payment and Termination of the Service)

  • ①Other charges (e.g., taxes, transaction fees, etc.) incurred in connection with the use of the Emotion Castle Cinema service monthly payment can be found on the 'Account' pageThe billing cycle is determined by the type of monthly subscription you selected when you signed up for Emotion Castle Cinema. The billing date may change in some circumstances, such as if the registered payment method is not processed properly, if the monthly subscription starts on a date that does not exist in a particular month, or if you change your subscription type. Please go to the Emotion Castle Cinema website and click 'Account' page and click the 'Payment details' link on the 'Account' page to see your next payment date. If you signed up for EmotionCastleCinema using a third-party account as a payment method, you can view your EmotionCastleCinema monthly payment information in that third-party account.
  • ② You must provide one or more payment methods to use the Emotion Castle Cinema service. The member is responsible for the outstanding amount. If a payment is not properly processed for reasons such as expiration, insufficient funds, etc. and the Member does not cancel the account, the Member's use of the Service may be restricted until the valid payment method is charged. For some payment methods, the issuer may charge the member a fee, such as a foreign transaction fee or other fees associated with processing the payment method. Local taxes may vary depending on the payment method used. Please check with your payment method service provider for more information
  • ③ Members may cancel their Emotion Castle Cinema subscription at any time, in which case they may continue to use the Emotion Castle Cinema service until the end of the billing cycle. No refunds or credits will be provided for the period of time that the subscription is not used or for unused Emotion Castle Cinema content. To cancel your subscription, please go to our homepage (http://cinema.emotioncastle.com) and follow the instructions for canceling. If you cancel your subscription, your account will automatically end at the end of your current billing cycle. You can find out when your account ends by clicking 'Payment details' on your 'Account' page. If you signed up for EmotionCastleCinema using a third-party account as a payment method, you may need to do so through that third party in order to cancel your account (for example, by accessing your third-party account and turning off auto-renewal or canceling your subscription to EmotionCastleCinema services through that third party).
  • ④ If a member terminates this Service Use Agreement, the posts made by the member will not be deleted.
  • ⑤ If the Member terminates the Emotion Castle Cinema subscription without using the Emotion Castle Cinema content within 7 days from the date of payment, the Member may request a full refund of the subscription fee charged for that billing cycle.
  • ⑥ The Company may refuse to provide the Service to the Member and terminate the Service use contract with the Member if there are any of the following reasons. In this case, the Company shall notify the Member of its intention to terminate by disclosing the reason for termination. However, the Company may give the member an opportunity to express his/her opinion on the reason for termination.
    • 1. If it is confirmed that there is a reason for rejecting the subscription application and a reason for canceling the subscription approval as stipulated in Article 4, Paragraph 2.
    • 2.the member has engaged in conduct that violates the rights, honor, reputation, or other legitimate interests of the Company, other members, or others.
    • 3.if the Member otherwise acts in violation of this Agreement and the Company's policies, or if any of the reasons for termination set forth in this Agreement occur.
    • 4.you have not used the Service for more than one year.

Article 15 (Protection of Personal Information)

  • Specific details of the Company's handling of personal information are set forth in the Privacy Policy.

Article 16 (limitation of liability)

  • ①The Company shall not be liable for the content and quality of products or services advertised by third parties through the screen in the Service or the linked website unless the Company is intentionally or grossly negligent.
  • ②The Company and its employees and agents shall not be liable for damages arising from the following unless there is intentional or gross negligence.
    • 1.damages attributable to false or inaccurate member information
    • 2.damages caused by the member in the process of accessing and using this service for reasons attributable to the member
    • 3.damages arising from any third party's unlawful access to the Company's servers or unlawful use of the servers, and damages arising from the process of preventing or deterring any third party's unlawful acts.
    • 4.damages caused by any viruses, spyware, and other malicious programs that you unlawfully transmit, disseminate, or cause to be transmitted or disseminated through the use of the Service by third parties.

Article 17 (Miscellaneous)

These Terms of Use shall be governed by and construed in accordance with the laws of the Republic of Korea.
